A Homeowners’ Association (HOA) is a legal entity created by a real estate developer for the purpose of developing, managing and selling a community of homes, as noted in the Articles of Incorporation of Del Sol Homeowners Association, Inc., which is filed with St Tammany Parish Clerk of Court’s office. The HOA has the authority to enforce the Covenants and Restrictions (C&Rs) and to manage the common areas of the development. Typically homeowners volunteer together to protect their property values and to improve the neighborhood. Most homeowners’ associations are nonprofit organizations in which the membership is both automatic and mandatory upon buying into.
In relation to an HOA, a director is an officer charged with the conduct and management of its affairs. The directors are referred to as a board of directors, and are either elected or appointed and are governed according to the By-Laws of the Del Sol Homeowners Association, Inc., which is filed with the St Tammany Clerk of Court’s office.
The term C&R refers to 'Covenants and Restrictions.' A real covenant is a legal obligation imposed in a deed by the seller of a home and or property upon the buyer of the real estate to do or not to do something. Such restrictions frequently 'run with the land' and are enforceable on future buyers of the property. Examples might be to maintain a property in a reasonable state of repair, not to run a business from a residence or not to build on certain parts of the property. Covenants are meant to protect a neighborhood from homeowners directly harming property values. Some can be more specific, outlining what a homeowner can do to the exterior of their home, what colors are acceptable to paint the home, when holiday decorations are allowed and where satellite dishes can be placed on the property, etc. Homeowners that fail to comply with the C&Rs may be assessed a fine by the Association. Del Sol Subdivision is governed by the Dedication of Servitudes, Easements and Restrictive Covenants, as filed with the St Tammany Parish Clerk of Court’s office.
By-laws are a set of rules or guidelines regarding the operation of a non-profit corporation such as a Board. Bylaws set forth definitions of offices and committees involved with the Board of Directors. They include voting rights, meetings, notices, and other areas involved with the operation of the Association. The By-Laws of the Del Sol Homeowners Association, Inc, are filed with the St Tammany Clerk of Court’s office.
Homeowner associations can require homeowners to pay a share of the common expenses, usually per-unit or based on square footage. The expenses are based upon the common property elements which can vary depending on the type of the association. All Homeowners are required to make timely and full payment of dues pursuant to the Dedication of Servitudes, Easements and Restrictive Covenants, as filed with the St Tammany Parish Clerk of Court’s office, Article VII ASSESSMENTS Section 1. Annual Assessments. Del Sol Homeowner assessment fees are currently $350 per year and due on the last day of February. Checks are required to be made payable to the Del Sol Homeowners Association and mailed to our management company or paid online.

If a property is sold, the dues should be pro-rated between buyer and seller. If you notify the title company they will take care of the prorate at closing. The Dues are not a discretionary payment. All Homeowners are required to make timely and full payment of dues pursuant to the Dedications of Servitudes, Easements, Restrictive Covenants, Article VII ASSESSMENTS Section 1. Annual Assessments. The Board is given authority to file a lien or foreclose any lien against property owners that fail to pay assessments when due. Article VII ASSESSMENTS Section 3. Non-Payment of Assessment. It is not the goal of the Association to file liens, so please pay your dues in a timely fashion. The Board thanks you for your cooperation. The maintenance and management services incurred by the Association are dependent upon timely receipt (on the last day of February) of the assessments due from each homeowner. Late payments and processing fees will follow the written schedule denoted in annual dues letter. In addition, the C&Rs allow the Association to charge cumulative late fees and interest and to proceed with a lien on your property or a judgment and collections for nonpayment of assessments.
The first step is to download Del Sol Property Owners Association, Application for Modification(s) form. Return the complete this form to Gulf South Property Management along with supporting documents. Gulf South Property Management will forward your request to the Architectural Control Committee for their review. If more documentation or explanation is needed you will be contacted. This process could take up to 30 days, but every effort will be made to complete the application process in the shortest time-frame as possible. Please do not start you enhancement project prior to completing the application process. This process is governed by the Dedication of Servitudes, Easements and Restrictive Covenants, as filed with the St Tammany Parish Clerk of Court’s office, Article VIII ARCHITECTURAL CONTROL COMMITTEE.
The process is the same as stated above with one exception. If your proposed shed is larger than 100 square feet or has power or plumbing, it will also require an approval from St Tammany Parish, as well.
